Art. 94. General selection principles

1. Contracts shall be awarded on the basis of criteria established in accordance with Articles 95 to 97, subject to verification, pursuant to Articles 85, 86 and 88, of the existence of the following conditions:

a) The tender complies with the requirements, conditions and criteria set out in the call for tender or in the invitation to confirm interest as well as in the tender documents, taking into account, where appropriate, Article 95, paragraph 14

b) The tender comes from a tenderer not excluded under Article 80 and who fulfils the selection criteria set by the contracting authority in accordance with Article 83 and, where appropriate, the non-discriminatory rules and criteria referred to in Article 91.

2. The contracting entity may decide not to award the contract to the tenderer who has submitted the most economically advantageous tender if it has ascertained that the tender does not meet the obligations referred to in Article 30, paragraph 3.
