Art. 118. Transport

1. Without prejudice to the exclusions referred to in Article 17, paragraph 1, letter 1), the provisions in this Chapter shall apply to activities relating to the provision or operation of networks providing a service to the public in the field of transport by railway, tramway, trolley bus, as well as by bus, automated systems or cable systems.

2. As regards transport services, a network shall be considered to exist where the service is provided under operating conditions laid down by the competent authorities, such as conditions on the routes to be served, the available capacity of transport or the frequency of the service.
