Art. 14. Contracts and design contests awarded or organized for purposes other than the pursuit of a covered activity or for the pursuit of such an activity in a third country

1. The provisions in this Code shall not apply to contracts which the contracting entities award for purposes other than the pursuit of their activities as described in Articles 115 to 121 or for the exercise of such activities in a third country, in conditions not involving the physical use of a network or geographical area within the European Union nor shall it apply to design contests organized for such purposes.

2. The contracting entities shall notify the European Commission, if so requested, of any category of activities which they regard as excluded under paragraph 1, within the terms thereby indicated, emphasizing in the notification which information have a sensitive commercial character.

3. The provisions in this Code relating to special sectors shall not apply to the categories of products or activities constituting the subject-matter of contracts in Article 1 and considered to be excluded by the European Commission by means of an act published on the Official Journal of the European Union.
